California's Supreme Court has upheld Proposition 8, a measure which bans same sex marriage. By doing so, however, the court recognized the legality of marriages performed before Prop. 8 was enacted. Now, as the issue winds its way through other state courts and legislatures, the debate grows more contentious, raising the fundamental question: Are civil rights best determined by popular vote?
