In this context, I believe Agreement and Treaty mean the same thing. NAFTA passed by bicameralism and presentment, meaning that both houses and the president signed it with a super-majority, which is what is also required of a treaty. In essence, it is a multi-lateral treaty.

Your other question comment suggests natural law versus legal positivism, and is well founded. But I think the word liberty and the word right is used interchangeably, but shouldn't be, if everyone understands the distinction you made. But expediency often conflates them.

Reading between the lines
Listen carefully to chapter 09: Justice Breyer clearly refers to NAFTA as a "Trade Treaty"? I have to believe that he is aware that NAFTA stands for "North American Free Trade Agreement". Is a treaty legally the same thing as an agreement? As I understand it all of the North American Union has been planned under the rubric of "agreements" Also in Chapter 03 Justice Breyer reduces the enumerated rights of Speech and Freedom of Religion to "Individual Liberties". As I understand it liberties are granted or taken and refering to a right as a liberty suggests that permission be granted. Rights are not granted (except by God), they are enumerated in The Constitution.
